Although the airspace above you is yours that doesn't mean someone else can't use it, just that they can't prevent you from using it. So if there is any contact directly above you, it is always their fault. So I would say that you can put your hand above someones head to knock the disk away, so long as you don't touch them and they don't touch you (still your fault, since it's their space).
